Legal validity

Every signature comes with its proof

The EU eIDAS Regulation (EU 910/2014) recognises the legal effect of electronic signatures and does not allow them to be denied value as evidence in court solely because they are electronic. In Spain, Law 6/2020 (Ley 6/2020) regulates electronic trust services.

If you want to start with the basics, read what an electronic signature is.

The evidence document

What the evidence document records

  • The document’s digital fingerprint before and after signing: any later change is detected.
  • Date and time of each step: sending, opening and signing.
  • The IP address and device used to sign.
  • How the signer was identified: their one-time code by email or SMS.

The company receives it instantly together with the signed document. Certified notifications leave their own record too: when each one was sent, when it reached the recipient’s inbox and when they opened it with their code.

Timestamp

A qualified timestamp on every document

Every signed document carries a qualified timestamp, issued by a provider on the Spanish Ministry’s trusted list.

The timestamp fixes the date and time of the signature. The eIDAS Regulation presumes that the date and time shown by a qualified timestamp are accurate, as is the integrity of the data it is bound to (Art. 41(2)).

Can’t find your question? Call us on +34 959 54 07 12 or message us on WhatsApp.

Are documents signed with InfoSign legally valid?

Yes. Every signed document comes with an evidence file with full validity and legal backing. In addition, every signed document carries a qualified timestamp, issued by a provider on the Spanish Ministry’s trusted list. The EU eIDAS Regulation recognises the legal effect of electronic signatures and does not allow them to be denied value as evidence solely because they are electronic.

What is the audit trail?

The file that accompanies every signed document and records how the signing process went: the document’s fingerprint before and after signing, the date and time of each step, the IP address and device, and how the signer was identified. The company receives it instantly together with the signed document, and it legally validates the process.

What is OTP verification?

An extra layer of security: before signing, the person receives a one-time code by email (and, if the company enables it, also by SMS) that confirms they are who they say they are.

Can I send certified notifications?

Yes. By email, with legal validity and proof of receipt: there is a record of when it was sent, when it reached the recipient’s inbox and when they opened it with their one-time code. No printing, no envelopes and no trips to the post office.
